These Terms & Conditions ("Terms") govern your use of the TwoDay mobile application ("App") and related services operated by TwoDay ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use TwoDay. If you are under 18, you must have permission from a parent or legal guardian. By using the App, you represent that you meet these requirements.

2. Account Registration

  • You may create an account using your email address or through Google, Apple, or Facebook sign-in.
  • You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
  • You agree to provide accurate information and to update it as needed.
  • You must notify us immediately if you suspect unauthorized access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are used in a manner that damages TwoDay or its users.

3. How TwoDay Works

TwoDay is a location-based discovery app that shows events, activities, and recreation happening near you within a 48-hour window. Key features include:

  • Event Pins: Events sourced from third-party providers (SeatGeek, Ticketmaster, and others) displayed as pins on the map.
  • Recreation Pins: Parks, trails, and outdoor activities displayed for discovery.
  • Groups: Users can create group events visible to other nearby users, with built-in chat.
  • Location-Based: The App requires location access to function. All content is shown relative to your current or selected location.

4. Third-Party Event Data

TwoDay aggregates event information from third-party sources. We do not guarantee the accuracy, completeness, or timeliness of this data. Event details including dates, times, locations, and availability are provided by external sources and may change without notice. Always verify event details with the official event organizer or venue before attending. TwoDay is not responsible for cancelled, rescheduled, or inaccurately listed events.

5. User-Generated Content

  • You retain ownership of content you create (group events, messages, photos, profile information).
  • By posting content, you grant TwoDay a non-exclusive, worldwide, royalty-free license to use, display, distribute, and store your content as necessary to operate and improve the App.
  • You are solely responsible for the content you post. Content must not be illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
  • We reserve the right to remove content that violates these Terms without prior notice.

6. Prohibited Uses

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Post false, misleading, or deceptive event information
  • Harass, threaten, or intimidate other users
  • Impersonate any person or entity
  • Distribute spam, malware, or malicious content
  • Attempt to gain unauthorized access to the App, other accounts, or our systems
  • Scrape, crawl, or use automated means to access the App without permission
  • Interfere with the proper functioning of the App
  • Use the App to promote illegal activities or substances

7. Intellectual Property

The App, including its design, code, graphics, logos, and branding, is owned by TwoDay and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our written permission.

8. Location Services

TwoDay relies on your device's location services. By using the App, you consent to the collection and use of your location data as described in our Privacy Policy. You may disable location services through your device settings, but this will prevent the App from functioning as intended.

9. Push Notifications

The App may send push notifications about group activity, event updates, and other relevant information. You can manage notification preferences within the App or through your device settings.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE MAKE NO GUARANTEES REGARDING THE ACCURACY OF THIRD-PARTY EVENT DATA DISPLAYED IN THE APP.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TWODAY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

  • Reliance on event information displayed in the App
  • Interactions with other users met through the App
  • Loss of data or unauthorized access to your account
  • Service interruptions or technical failures

12. Indemnification

You agree to indemnify and hold harmless TwoDay and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may delete your account at any time through the App. Upon termination, your right to use the App ceases immediately, though provisions that by their nature should survive termination (such as Limitation of Liability and Indemnification) will remain in effect.

14. Governing Law

These Terms are governed by and construed in accordance with applicable Canadian federal and provincial laws. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of competent jurisdiction in Canada.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App and updating the "Last Updated" date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
